Description

Whether a juveniles non-custodial, inculpatory statements, made after the juvenile has already given police a confession inadmissible under state law because a magistrate was not present, are nevertheless voluntary and therefore admissible without offense to the Fourteenth Amendment to the United States Constitution must be determined from the totality of the circumstances. Our main inquiry here is whether the court of appeals correctly applied this test in holding that the admission of a juveniles statements was error. We hold that it did not and therefore reverse the judgment of the court of appeals and reinstate the trial courts adjudication of delinquency.
